Terms of Service

Welcome to Northway Golf. These Terms of Service ("Terms") govern your use of the Northway Golf mobile application (the "App") and the www.northway-tech.com website (the "Website"), operated by Northway Technologies Incorporated, a Corporation formed in Nevada, United States ("Company," "we," "us," "our").

By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

The App is available to users of all ages, subject to the following conditions:

Users under 13: A parent or legal guardian must provide verifiable consent before an account can be created. See our Privacy Policy for details on our COPPA compliance.
Users 13-17: You represent that you have your parent's or legal guardian's permission to use the App.
Users 18+: You represent that you are of legal age to form a binding contract.

2. Account Registration

You must provide accurate information during registration, including a valid email address, username, and date of birth.
You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activity that occurs under your account.
You must notify us immediately at support@northway-tech.com if you suspect unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

Use the App for any unlawful purpose or in violation of any applicable laws
Post or transmit content that is offensive, defamatory, obscene, or otherwise objectionable
Harass, bully, or intimidate other users
Impersonate another person or entity
Upload malware, viruses, or other harmful code
Attempt to gain unauthorized access to other users' accounts or our systems
Use automated systems (bots, scrapers) to access the App without our permission
Circumvent age restrictions or parental controls
Manipulate leaderboards, scores, or other competitive features through dishonest means
Use the App in a way that could damage, disable, or impair our servers or networks

4. User-Generated Content

The App allows users (age 13+) to submit content including course reviews, photos, videos, and profile information ("User Content").

You retain ownership of your User Content.
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content within the App for the purpose of operating the service.
You represent that you have the right to submit all User Content and that it does not infringe any third party's rights.
We may remove User Content that violates these Terms or that we find objectionable, at our sole discretion.
We are not responsible for User Content posted by other users.

5. GPS and Location Data

The App uses GPS location data to provide golf gameplay features including shot tracking, distance calculations, and course navigation.
Location data is collected only when you are actively using gameplay features.
You can disable location services at any time through your device settings, though this will limit App functionality.
See our Privacy Policy for details on how location data is used and stored.

6. Voice Assistant

The App includes an AI-powered voice assistant feature.
Voice data is processed to provide golf-related guidance and may be stored on our servers.
The voice assistant provides suggestions only and should not be relied upon as professional golf instruction.
You can delete your voice conversation history at any time within the App.

7. Subscriptions and Purchases

Some features require a paid subscription or one-time purchase.
Purchases made through the Apple App Store are governed by Apple's terms. Purchases made through Google Play are governed by Google's terms. Web purchases are processed by Stripe.
Subscription prices are displayed before purchase. Recurring subscriptions will auto-renew unless cancelled before the renewal date.
Refund requests for App Store and Play Store purchases must be directed to Apple or Google respectively.
We reserve the right to change pricing with reasonable notice.

8. USGA/GHIN Integration

The App offers optional integration with the United States Golf Association (USGA) handicap system (GHIN).
If you choose to link your GHIN account, your handicap data will be shared between the App and USGA.
We are not responsible for the accuracy of handicap calculations performed by USGA.
Your use of GHIN services is also subject to USGA's terms and conditions.

9. Intellectual Property

The App, including its design, features, code, and content (excluding User Content), is owned by Northway Technologies Incorporated and protected by copyright, trademark, and other intellectual property laws.
The Andy North virtual caddie character and associated AI personality are proprietary to Northway Technologies.
You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.
You may not reverse engineer or attempt to extract the source code of the App.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
Golf course data, distances, and recommendations are approximate and should not be solely relied upon.
The App is not a substitute for professional golf instruction or medical advice.
We are not responsible for any injuries or damages resulting from the use of the App during golf play.
Weather data provided within the App is sourced from third parties and may not be accurate.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NORTHWAY TECHNOLOGIES INCORPORATED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use or inability to use the App
Any unauthorized access to or use of our servers or personal information stored therein
Any interruption or cessation of the App
Any errors or inaccuracies in the App's content or data

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Northway Technologies Incorporated, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, your User Content, or your violation of these Terms.

13. Termination

You may delete your account at any time through the App or by contacting support@northway-tech.com.
We may suspend or terminate your account at any time for violation of these Terms, with or without notice.
Upon termination, your right to use the App ceases immediately.
Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Indemnification) will survive.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
Any disputes arising from these Terms or the App shall be resolved through binding arbitration in Orange County, California, except that either party may seek injunctive relief in court for intellectual property violations.
You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
